TERMS OF SERVICE

DISCLAIMER
• By purchasing my art services, you acknowledge that you have read, understood, and agree to all Terms of Service outlined here.
• Usage of the commissioned work for AI (artificial intelligence) or machine learning platforms, NFT creation or blockchain-related purposes is strictly prohibited.
• Do not redistribute, reproduce, edit, or resell my work. Commissions are for PERSONAL USE only unless discussed otherwise.GENERAL
• By commissioning me, you are purchasing my service as an artist only.
• I reserve the right to decline any project or client for any reason.
• The purchase is for digital files only. No physical copies will be provided or shipped
• I reserve the right to post your finished artwork in my gallery for any reason, unless asked not to.
• I reserve the right to refund you the full amount paid if I no longer wish to work on your project for any reason.
• Please do not ask me to draw in another artistic style that isn’t my own.
• As an artist, my art is constantly evolving, so there might be slight differences between the samples in my gallery and the illustration you will receive. Please keep that in mind.
• I mainly draw female characters and rarely male characters. Please keep in mind when commissioning me.
• It is your responsibility to save the commission within a week of receiving the final commission files. In case you’re unable to do so, please let me know as soon as possible. I do not keep files in my Drive folder for a long time, so any lost files that weren’t saved within 1-2 weeks are the responsibility of the customer and therefore won’t be refunded. (this doesn’t apply to files sent through e-mail or discord)CLIENT
• By commissioning me, you agree that you have read and accepted all the terms described herein.
• By commissioning, you confirm that you are of legal age and accept full responsibility for any monetary exchange related to this service.
• You will agree to the policy of using the art for personal, non-profit purposes unless otherwise stated
• You may not claim the commissioned artwork as your own under any circumstances. Proper credit to the artist is required if the artwork is shared or posted.
• You will receive both a full resolution and smaller resolution digital file delivered through email, Discord, or Google Drive. No physical item will be shipped.
• Please only upload the smaller file publicly unless otherwise discussed.
• You are NOT authorized to trace over my Artwork in any way, including the use of the artwork as a “base.”
• You are NOT authorized to change, modify, edit or use my works without my permission.
• You are NOT allowed to remove any watermarks/signatures.COMMISSION PROCESS
1. Contact me (Twitter DM or email) about your commission. Provide the following information: idea, commission type, references
2. After we agree on the order, provide me your personal information (name, surname and e-mail) for the invoice
3. I'll start working, send you a sketch and get your feedback
4. Regular updates will be given as the work gets done
5. Once the commission is completed, I will send you the finished work in high resolution via Google Drive, Discord or email.
6. One minor revision after work is finished. Major or extra edits will cost extra, unless I did an obvious mistake (e.g. I overlooked details provided in the order)COMMERCIAL RIGHTS
• If you wish to order a commission for Commercial use, the total price of the commission, as well as any other royalties, will be agreed upon upfront.
Commercial use includes, but is not limited to, reproducing and selling the artwork, whether publicly or privately. Additionally, any situation where you earn profit or gain recognition/exposure by sharing my artwork on a platform or medium is considered commercial use (e.g. Patreon, YouTube, Twitch, a personal site, business cards, etc).

• I reserve the right to sign and/or watermark my own work.
• I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a Public Commission, I may do whatever I wish with the art (e.g. post it to other sites such as Twitter) but will give proper credit to you for ownership of the character’s design.
• In the case of a commission, I will not claim the rights to a character design unless it was one of my own designs. Therefore I will not reuse/resell the Artwork for personal or commercial projects unless agreed upon.PAYMENTS & FEES
• Payment method: Paypal only
• Payments are only accepted in EURO and will be taken via Paypal invoice.
• All payments are paid upfront, or through a payment plan for higher value projects if discussed prior
• Your commission order will be canceled if you fail to pay within 48 hours.
• Rush fees are at least + 25% of the commission. Fees might vary depending on the project and the timeframe provided. This applies when you want to skip the waitlist and get the commission done by a deadlineREFUNDS
• I can refund 100% of the payment only if I have not started working on the sketch.
• Once I start the sketch there will be NO REFUNDS.
• If I cancel a project, I will reimburse the lost fees and refund 100%.
• If we agree on a payment plan and I start the commission after the first deposit has been done, I will not refund your said deposit if you back out of the Payment Plan.CHARGEBACK
• You are NOT authorized to issue a chargeback for any reason.
• If for any reason your PayPal account malfunctions or authorizes a refund request without your knowledge, you must contact me as soon as possible in order to resolve the issue.
• You are required to contact me when you need to cancel a commission request.
• Purposefully issuing a chargeback without contacting me to cancel/refund a project will result in immediate blacklisting for you as well as your email address, and anyone sharing your PayPal account, including side accounts.QUEUE / SCHEDULING / WORK SPEED / DEADLINES
• I usually take up to 2-5 days to respond to your initial order inquiry.
• You reserve the right to set a deadline for your commission. This deadline must be disclosed prior to payment.
Completion time varies depending on queue, art complexity and any other issues (usually between 1 week and 3 months). Unless it is a priority commission then it will be completed within the agreed deadline.
• I have the right to decline a project if there is too short of a time allowance.
• If due dates are discussed, it is also the client's responsibility to ensure prompt communication. I will not be held responsible for late delivery.
• No harassment over my work speed will be tolerated, regardless of the time that has passed.
• I will work on commissions randomly. This means I will work on the piece I'm the most inspired/ comfortable with at the moment.
• You reserve the right to be notified of any delays.
